PUBLIC NOTICE NOTICE OF DEFAULT AND SALE OF SEIZURE WHEREAS on March 23, 2011, a certain mortgage was executed by Jean C. Harris and Leslie A. Harris, wife and husband, as mortgagor in favor of Bank of America , NA, a national banking association and was recorded on April 4, 2011 in the book RLPY: 2011, page: 13734, in the Office of the Estates Judge of Elmore County, Alabama, and WHEREAS the mortgage was insured by the United States Secretary of Housing and Urban Development (the Secretary) in accordance with the National Housing Act for the purpose of providing single-family housing; and WHEREAS the Mortgage now belongs to the Secretary by virtue of an assignment; said mortgage transferred and assigned to Nationstar Mortgage, d / b / a Champion Mortgage Company dated September 4, 2012 and recorded on September 11, 2012 in the book RLPY: 2012, page: 45731 said mortgage transferred and assigned to Nationstar Mortgage, LLC d / b / a Champion Mortgage Company via a corrective sale dated September 4, 2012 and recorded on August 22, 2014 in the RLPY 2014 book, page 33845; said mortgage transferred and assigned to Bank of America, NA as of November 1, 2017 and recorded on December 16, 2017 in the RLPY Book 2017, page 62273; said mortgage transferred and assigned to the Housing and Urban Development Secretariat on July 19, 2018 and recorded on September 14, 2018 in the book RLPY 2018, page 44200; said mortgage transferred and assigned to the Secretary of Housing and Urban Development dated August 17, 2018 and recorded September 14, 2018 in the RLPY 2018 book, page 44203 at the Elmore County Estates Office, Alabama; and WHEREAS a breach was made to the clauses and conditions of the mortgage in that the payment due on September 13, 2021 has not been made and remains fully unpaid on the date of this notice, and that no payment has been made. ‘has been made sufficiently to re-establish the currency loan; and WHEREAS the total amount overdue as of October 13, 2021 is $ 273,637.99; and WHEREAS, by virtue of this default, the Secretary declared immediately due and payable the total amount of the debt secured by the mortgage; THEREFORE, in accordance with my powers under the Single Family Mortgage Foreclosure Act of 1994, 12 USC 3751 et seq. 2019, page 36076 on probate records for Elmore County, Alabama, the notice hereby gives that on February 9, 2022 between 11:00 a.m. and 4:00 p.m. local time, all real and personal property in or used in connection with the premises described below (“Property”) will be sold at public auction outside the main entrance of Elmore County, Alabama, Courthouse, in the town of Wetumpka, Elmore County, Alabama, to the highest bidder : Begin at the southwest corner of the northern half of the northwest quarter of Section 34, Township 20 North, Range 19 East, thence 1786 feet to the eastern right-of-way line of a paved county road (Grier road); thence northwesterly along the eastern right-of-way of the said road 506 feet to the starting point; thence north 86 degrees 15 minutes east 553.45 feet; thence north 8 degrees 45 minutes west 811.43 feet to the southern right-of-way of a paved county road; thence southerly 79 degrees 12 minutes westerly along said southern right-of-way line 583.8 feet to the eastern right-of-way line of said Grier Road right-of-way; thence southerly 11 degrees 21 minutes easterly along said eastern right-of-way line of Grief Road a chord distance of 741.43 feet to the point of commencement.
